The Committee on Energy and Public Works moved to amend the bill by striking out everything after the enacting clause and inserting in lieu thereof the following:

Be it enacted by the Legislature of West Virginia:

 

ARTICLE 4. STATE ROAD SYSTEM.

§17-4-56. Rumble strips required on certain double-yellow lined roads.

 

(a) The commissioner shall examine the accident rate on all double-yellow lined roads and highways, which are serious or fatal in nature, and have a nexus to a vehicle having impermissibly crossed into the lane of oncoming traffic. Implementation of such examination shall commence not later than September 1, 2026, and shall be completed not later than December 31, 2026.   

(b) Not later than July 1, 2027, the commissioner shall develop a plan by which rumble strips shall be placed on center lines, of at a minimum, the 20 percent of those double-yellow lined roads and highways with the highest accident rates as determined by the examination required in §17-4-56(a).  Such placement shall be undertaken at the next paving of those roads and highways in conjunction with their regular repaving cycle, but shall be completed not later than July 1, 2047: Provided, no such strips shall be installed within 500 feet of any residence, within 50 feet of any intersection or driveway, or, where they would violate any generally accepted principles of highway engineering.
